Yeah, that's what he is saying. Though, he's an IT guy or something, so the prosecution is, of course, accusing him of being a "hacker." holy moly, now that gets interesting.

Wow, you can pretty much fill in the lines of this story..
The woman comes out of high school with her first husband and has a baby(possibly during high school). When she's older(though not any more mature), she "realizes what she's missed out on in life" and has a fling with her attractive, sensual, yet poor second husband. She realizes he's broke and that being with him will be a life of squalor so she starts dating online. She finds a nerd who treats her right, but doesn't fulfill her sexually so she returns to her second husband for that.
When caught, she now needs a way to get husband 1's child, husband 2's passion, and husband 3's money.

If the district attorney's office has time and resources to prosecute this absurd case, then that municipality needs to trim the fat off its budget.
Aren't their some potholes in town to be fixed? Or maybe buy a couple new garbage trucks?
Seriously, if the prosecutor pushes for this to be tried in court, s/he should be fired, immediately.
If two people have legally married, and live together, in the same dwelling, share laundry, dishes, and a bedroom, and share the same material possessions, including a computer, it is absolutely absurd that a husband could be jailed for looking at her email.
If he had stolen money from her personal bank account, defamed her publicly with illicit photos, or used her email account to send harassing messages or malware, THEN there might be some sort of criminal case. But reading her emails and finding out she's having an affair? The only criminal here is the woman ... the crime of being stupid. Why the hell would someone save incriminating email in their mailbox unless she is just plain stupid, or is trying to get caught.

I don't think the financial allotments work that way(bolded)

This is the kinda crap you see on all those damn judge shows. Sick Judge Judy on her *** for being so stupid.
If this guy goes to jail then surely the "Justice" system has failed once again. I think it needs an overhaul and a new name.

Wow, she's nuts. Or else I am just way too lax. I give my husband the password to my computer and email so he can fix anything I break while I'm at school. Hecks, I even forward half of my emails from the University to him because they involve stuff both of us should know. He has my password to log Liela into FFXI if he needs me while I am at school. And if I am busy and my phone rings, I ask him to answer it for me, or at least check who's calling. If I get a text and my hands are full or I'm busy, I'll usually ask him to check it and tell me who it was and what they wanted.
Then again, I have nothing to hide and would never betray him. So, I guess that was her problem. If she hadn't been cheating, she probably wouldn't have cared at all.

Asura.Ina said: Its not only in marriage... Drivers insureance men get higher rates just for being a man as an example...
I'm all for gender equality but I wana see some real equality not equal on the good stuff but still getting treated better on everything else.
It's not random, genius, and it's not because insurance companies hate men - it's based on how often various groups of people get into accidents. Teenagers get into more accidents than adults = higher raters. That kind of thing.
Or maybe everyone should just pay more?
Edit, on topic: This seems like a complete waste, and that it's a criminal trial rather than a civil on is just obnoxious. Obviously she wasn't happy in the marriage - I can't really comment on the overall health of the relationship, but w/e - and if this did anything to help bring along the end of that relationship, she should be relieved.
Quote: http://www.freep.com/article/20101226/NEWS03/12260530/Is-reading-wife-s-e-mail-a-crime?-Rochester-Hills-man-faces-trial
A Rochester Hills man faces up to 5 years in prison -- for reading his wife's e-mail.
Oakland County prosecutors, relying on a Michigan statute typically used to prosecute crimes such as identity theft or stealing trade secrets, have charged Leon Walker, 33, with a felony after he logged onto a laptop in the home he shared with his wife, Clara Walker.
Using her password, he accessed her Gmail account and learned she was having an affair. He now is facing a Feb. 7 trial. She filed for divorce, which was finalized earlier this month.
Legal experts say it's the first time the statute has been used in a domestic case, and it might be hard to prove
"It's going to be interesting because there are no clear legal answers here," said Frederick Lane, a Vermont attorney and nationally recognized expert who has published five books on electronic privacy. The fact that the two still were living together, and that Leon Walker had routine access to the computer, may help him, Lane said.
"I would guess there is enough gray area to suggest that she could not have an absolute expectation of privacy," he said.
About 45% of divorce cases involve some snooping -- and gathering -- of e-mail, Facebook and other online material, Lane said. But he added that those are generally used by the warring parties for civil reasons -- not for criminal prosecution.
"It is an indication of how deeply electronic communication is woven into our lives," Lane said.
Leon Walker was Clara Walker's third husband. Her e-mail showed she was having an affair with her second husband, a man who once had been arrested for beating her in front of her small son. Leon Walker, worried that the child might be exposed to domestic violence again, handed the e-mails over to the child's father, Clara Walker's first husband. He promptly filed an emergency motion to obtain custody.
Leon Walker, a computer technician with Oakland County, was arrested in February 2009, after Clara Walker learned he had provided the e-mails to her first husband.
"I was doing what I had to do," Leon Walker told the Free Press in a recent interview. He has been out on bond since shortly after his arrest. "We're talking about putting a child in danger."
Oakland County Prosecutor Jessica Cooper defended her decision to charge Leon Walker.
"The guy is a hacker," Cooper said in a voice mail response to the Free Press last week. "It was password protected, he had wonderful skills, and was highly trained. Then he downloaded them and used them in a very contentious way."
Walker's defense attorney, Leon Weiss, said Cooper is "dead wrong" on the law.
"I've been a defense attorney for 34 years and I've never seen anything like this," he said. "This is a hacking statute, the kind of statute they use if you try to break into a government system or private business for some nefarious purpose. It's to protect against identity fraud, to keep somebody from taking somebody's intellectual property or trade secrets.
