He might be correct that it doesn't qualify as cake though in the same way cheese cake isn't a pie despite being similar. I don't really know for sure though.

Most ice cream cakes I ate contained a baked cake component, the only ones that didn't were the ones from Dairy Queen. I don't know other people's experiences.
