I think the legal threshold for hate speech is a bit higher than that...

Freedom of speech protects you from criminal prosecution and censorship from the government, not from responsibility, monetary or otherwise. There are consequences to preaching hate like he is, and those consequences are often paid by innocent bystanders at the hands of unstable people. Let me know when Trump is promoting violence towards Mexico I can wait !
